More Claims Against Rock Tops
The Detroit Free Press reported that creditors filed two more suits for non-payment this month, and one creditor filed an injunction to stop a possible sale of company assets.
Indus Trade & Technology LLC of East Brunswick, N.J., filed a suit in Macomb County Circuit Court yesterday. Indus, a stone importer, alleges that Rock Tops owes them $476,000 for purchases made within the past two months, according to the Free Press.
In addition, the landlord for Rock Tops’ Macomb Township building cited a breach of lease in filing against the company on Jan. 16 for $240,000. Rock Tops entered into a 52- month lease last January, noted the Free Press, but rent payments stopped in December.
The suits join two filed by creditors earlier this month. Dwyer Marble and Stone of Farmington Hills, Mich., seeks $890,395 for unpaid stone deliveries, and GranQuartz LLC of Tucker, Ga., claims an unpaid balance of $323,998 for fabrication machines and tooling.
Attorneys for GranQuartz also filed an injunction against Rock Tops to stop any sale of equipment and other goods from the fabrication supplier. A hearing on the injunction is scheduled for Feb. 5.
Rock Tops, which operated 15 showrooms in seven states, along with centralized fabrication facilties in Macomb, shut its doors on Dec. 19. The company, in addition to the creditors filing suit, also owes an undetermined amount to customers who pre-paid for countertops and other products that weren’t delivered before the mid-December shutdown.
